Andrew Francis (Andrew Francis was called to the Bar in 1977 and is in practice at 11 New Square, Lincoln’s Inn. He specialises in Rights to Light and Restrictive Covenants and is a member of the Pyramus & Thisbe Club. He is the author of Restrictive Covenants and Freehold Land – A Practitioner’s Guide (Sweet & Maxwell, June 1999) and is the co‐author with Stephen Bickford‐Smith of Rights of Light – The Modern Law (published by Jordans in March 2000). )

Abstract

The law relating to light is complex. This paper explains the law of light, how rights to light may be acquired, and how they may be defended. The particular positions of landlords, tenants, the Crown and the City of London are explained in the context of the law of light. In addition, the relevance of claims for injunctions and damages is also explained in this context.
