Abstract

Briefly defines defamation. Outlines the classes of defamation and the elements which must exist before action can be called. Considers particular defamation including opinion; humour, satire, epithets and fiction; inducement colloquium and innuendo. Lists the most common reasons encountered in claims of defamation. Covers the types of damages which may be awarded: special, general and punitive and what mitigation may be used. Concludes that this is an area which is often overlooked and training is required to ensure it is avoided.
