California lead-paint lawsuit dismissed

A judge in Santa Clara County, CA, on 15 July dismissed a lawsuit filed by several San Francisco Bay area government agencies that sought to hold paint manufacturers responsible for health problems related to lead-based paint, the NPCA reported. Santa Clara County in March 2000 filed a class-action lawsuit to recover government costs linked to lead paint exposure and control. The plaintiffs, which included San Francisco, Santa Cruz, Alameda, Solano, and Kern counties, alleged that the defendants knew about the dangers of lead-based paint when they sold it.

In dismissing the suit, the judge said the alleged actions occurred 50-100 years back. The plaintiffs had argued that the statute of limitations did not apply in this case because they did not know about hazards of lead- based paint until recently.
