Assistance with new EU e-procurement rules

The European Commission has published a guide to the rules on electronic public procurement that form part of the new procurement Directives. These rules need to be implemented across Europe by the end of January 2006. The aim of the guide is to provide clear answers to questions on the legal aspects of e-procurement, covering all stages of the contract award procedure that can be computerised, as well as the new instruments and purchase techniques. These include electronic auctions. Although electronic auctions cannot be used for services contracts or certain works contracts, such as design contests which involve intellectual performance, they can be used to purchase, for example, maintenance works. The document analyses the rules applicable to online communications from a practical and pragmatic point of view.
